Canada Spousal Sponsorship Requirements for Nigerian Couples

Canada is one of the top destinations for Nigerians looking to build a better future, and many couples want to settle there together. The spousal sponsorship program is one of the main ways for Nigerians married to Canadian citizens or permanent residents to gain permanent residency. Through this program, Canada allows family reunification by letting Canadian residents sponsor their spouses to live, work, and eventually become citizens.

Applying for spousal sponsorship is a detailed process that requires meeting strict requirements, providing accurate documents, and proving that the marriage is genuine. This article will explain everything Nigerian couples need to know, from eligibility to documentation and the steps involved in the application.

What is Spousal Sponsorship in Canada?

Spousal sponsorship is part of Canada’s family class immigration program. It allows a Canadian citizen or permanent resident to bring their husband or wife to Canada as a permanent resident. The sponsored spouse gains the right to live and work in Canada while building a future with their partner. This pathway is especially attractive to Nigerian couples because it gives the sponsored spouse access to healthcare, education, and employment opportunities, along with a clear route to citizenship after a few years.

Eligibility Requirements for Canadian Sponsors

Not everyone living in Canada can sponsor a spouse. The sponsor must meet certain conditions:

1. Status in Canada

  • Must be a Canadian citizen, permanent resident, or a person registered under the Canadian Indian Act.
  • If living outside Canada, citizens can sponsor their spouse if they plan to return after approval. Permanent residents must be residing in Canada at the time of application.

2. Age Requirement

  • The sponsor must be at least 18 years old.

3. Financial Ability

  • Sponsors are expected to prove they can support their spouse financially without relying on government assistance.
  • While there is no specific income threshold for sponsoring a spouse, sponsors must show they can provide basic needs like food, housing, and clothing.

4. No Ineligibility Issues

Sponsors may be ineligible if they:

  • Are currently in prison.
  • Have declared bankruptcy and not been discharged.
  • Have previously failed to support a sponsored spouse.
  • Were themselves sponsored as a spouse and have not completed the required period before sponsoring another.

Eligibility Requirements for the Sponsored Spouse

The Nigerian spouse being sponsored must also meet certain requirements:

  • Must be legally married to the sponsor with a valid marriage certificate. Customary or religious marriages are accepted if legally recognized in Nigeria.
  • Must undergo medical examinations approved by Canadian immigration authorities.
  • Must provide police certificates from Nigeria and any other country lived in for more than six months since the age of 18.
  • Cannot be inadmissible due to serious criminal records, medical issues, or misrepresentation.

Documents Needed for Nigerian Couples

Proper documentation is essential to prove the relationship and meet Canadian immigration standards. Commonly required documents include:

  • Valid Nigerian passport of the sponsored spouse.
  • Canadian sponsor’s passport, citizenship certificate, or permanent resident card.
  • Marriage certificate.
  • Photographs of the wedding, couple together, and family gatherings.
  • Communication records such as call logs, chats, or social media interactions.
  • Travel history showing visits between the couple.
  • Proof of financial support such as money transfers or shared bank accounts.
  • Police clearance certificates from Nigeria and other countries lived in.
  • Medical exam results from an approved panel physician.

Types of Sponsorship Applications

There are two main types of applications for spousal sponsorship:

1. Inland Sponsorship

This applies when the Nigerian spouse is already living in Canada, possibly on a temporary visa. The application allows them to remain in Canada while waiting for approval and even apply for an open work permit.

2. Outland Sponsorship

This applies when the Nigerian spouse is outside Canada, such as living in Nigeria. The application is processed through the visa office that handles Nigerian cases, usually the Canadian High Commission in Accra, Ghana. Outland applications often allow faster travel but require the spouse to remain outside Canada until approval, unless they have a valid visa to visit.

Application Process Step by Step

1. Complete the Application Package

Applicants must download the correct application package from the Immigration, Refugees, and Citizenship Canada (IRCC) website. It contains forms for both the sponsor and the spouse.

2. Pay the Required Fees

The application fee covers sponsorship processing, permanent residence application, and biometrics. As of now, the total is around CAD $1,080, but fees may change.

3. Submit the Application

Completed applications are sent to the processing center in Canada. Incomplete applications may be returned, causing delays.

4. Provide Biometrics

The Nigerian spouse will be asked to provide fingerprints and a photograph at a visa application center.

5. Attend Medical Examination

The Nigerian spouse must complete a medical exam by an IRCC-approved doctor.

6. Wait for Processing

The application goes through several stages of review, including eligibility checks for the sponsor and admissibility checks for the spouse.

7. Interview (If Required)

Sometimes, IRCC may request an interview to further verify the genuineness of the marriage. Nigerian couples may be asked detailed questions about their relationship history.

8. Receive Permanent Residence

Once approved, the Nigerian spouse is issued permanent residence. They can then travel to Canada and begin their new life with their partner.

Processing Time for Nigerian Couples

On average, spousal sponsorship applications take around 12 months to process, although delays are possible if additional documents or interviews are required. Outland applications from Nigeria are usually processed through Accra, Ghana, which may affect timelines.

Common Mistakes to Avoid

  • Submitting incomplete forms or missing signatures.
  • Failing to provide enough evidence of a genuine relationship.
  • Not paying the correct fees.
  • Ignoring requests for additional information from IRCC.
  • Providing false or inconsistent information, which can lead to bans.

Rights and Benefits After Approval

Once the Nigerian spouse becomes a permanent resident of Canada, they can:

  • Work and study without restrictions.
  • Access public healthcare.
  • Travel in and out of Canada freely (with certain residency requirements).
  • Apply for Canadian citizenship after meeting residency conditions, usually three years.
Spousal sponsorship is one of the most reliable ways for Nigerian couples to reunite in Canada and build a future together. While the process requires careful attention to eligibility, documentation, and deadlines, couples who prepare well stand a much better chance of success. Gathering strong evidence of a genuine marriage and ensuring all forms are complete will reduce delays and increase the likelihood of approval.
