The U.S. spouse or green card holder must first file Form I-130, Petition for Alien Relative, with the United States Citizenship and Immigration Services (USCIS). This form establishes the validity of the relationship. Along with the form, couples must submit:

  • Marriage certificate.
  • Proof of citizenship or permanent residency.
  • Photos together.
  • Joint documents such as leases, bank accounts, or insurance policies.

2. USCIS Review

USCIS reviews the petition and supporting evidence to determine if the marriage appears genuine. Approval moves the case forward, while requests for additional evidence can delay the process.
